    ALERTE DROIT SOCIAL – Souffrance au travail : l’employeur n’est pas responsable s’il a pris les mesures de prévention suffisantes


    💡 L’employeur est tenu, en vertu de son obligation de sécurité, de prendre toutes les mesures nécessaires pour assurer la sécurité et protéger la santé physique et mentale de ses salariés (C. trav., art. L. 4121-1 et L. 4121-2). Il n’est exonéré de sa responsabilité que s’il démontre avoir tout mis en œuvre pour limiter le risque (Cass. soc., 25 nov. 2015, nº 14-24.444).

    📢 Dans une décision récente du 9 avril 2025 (n°23-22.121), la Cour de cassation a réaffirmé ce principe dans le cadre d’une situation de souffrance au travail. Elle a ainsi jugé qu’un employeur était exonéré de sa responsabilité, dès lors, qu’après avoir eu connaissance du mal-être d’une salariée, il avait pris de nombreuses dispositions pour l’en prémunir. En l’occurrence, l’employeur avait :

    1. Mis en place un suivi par le médecin du travail et par la directrice des ressources humaines ;
    2. Réalisé une enquête interne afin d’évaluer les causes des difficultés signalées par la salariée ;
    3. Mis en œuvre un dispositif spécifique de suivi régulier de l’évolution de la situation lors de sa reprise et la mise à disposition d’un psychologue.
