    Expertise

    François Muller assists contractors and industrialists in their projects and disputes, especially in relation to public procurement contracts, JV agreements, construction law, and subcontracting, as well as judicial review of calls for tenders and the filing and litigation of claims in that fields. His clientele encompasses the engineering & construction sectors, the defense and nuclear industries, and railway rolling stock manufacturers.

    He has acted as counsel in arbitration procedures, whether administered (ICC, European Development Fund (“EDF”)) or ad hoc.

    François Muller is a lecturer at the University of Paris II (Panthéon Assas), PgD International Construction Contracts, and a member of the Association Fran-çaise d’Arbitrage (French Arbitration Association), the International Bar Associ-ation (IBA, and a previous moderator within the International Construction Projects committee), the Dispute Resolution Board Foundation (DRBF) and the ICC (Arbitration and ADR commission of the French Committee).

    Admitted to the Paris bar in 1999, François Muller practiced at Rambaud Martel (1999) and Proskauer Rose (2005) before joining ADVANT Altana as a partner upon its creation in 2009.

    • advise/mark up, contractor’s side, of several hundred million € D&B contract fort he foundations of an off shore windmill project
    • several lawsuits related to rolling stock material EPC public procurement contracts award in France, contractor’s side, each reprensenting hundred+ to several hundred million €
    • co-counsel in an ICC arbitration for an Asian main contractor against a Moroc-can subcontractor in the frame of a large plant project
    • counsel of the contractor in a multiparty litigation related tot he revamping and extension of a luxury hotel, involving side OS&E vs OS&E issues, contrac-tor’s lump sum price and consultant’s incentives, … for multi million €
    • ICC arbitration between partners in a consortium in charge with the design and build of a major airport infrastructure equipment, under the French law (counsel for plaintif, claims amount : 100 M€)
    • ICC arbitrations in Algeria, for Contractors of Public entities (railway infrastruc-ture projet), under Algerian law (counsel for plaintifs claims amounts, 12 M€)
    • Mediation related to interruption of hospital’s public works in Haïti, involving the contractor, the employer and the MDBs‘ funders (counsel for an MDB, claim amount 15 M$
    • Routinely involved in call for bonds/bank guarantees litigation relating to in-ternational construction project
